Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Aether AI LLC(“Aether AI,” “we,” “us,” or “our”) governing your use of the Meal Planner website and application (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Important health disclaimer
Meal Planner is a general wellness and informational tool. It does not provide medical, nutritional, dietary, or other professional health advice, diagnosis, or treatment, and it is not a substitute for consultation with a qualified physician, registered dietitian, or other healthcare professional. Meal plans, calorie and macronutrient targets, recommendations, and other content are generated in part by automated systems (AI) and may be inaccurate, incomplete, or unsuitable for your circumstances. Always seek the advice of a qualified professional before starting, changing, or stopping any diet, exercise, or health program, and especially if you are pregnant or nursing, have a medical condition or food allergy, take medication, or have a history of disordered eating. Never disregard professional medical advice or delay seeking it because of something you read or received through the Service. If you think you may have a medical emergency, call your doctor or emergency services immediately. You use the Service and any content it provides at your own risk.
2. Eligibility
You must be at least 18 years old to use the Service. By using it, you represent and warrant that you are 18 or older, that you have the capacity to enter into these Terms, and that you are not barred from using the Service under applicable law.
3. Your account
You are responsible for the information you provide, for maintaining the confidentiality of your login credentials, and for all activity under your account. Provide accurate information and keep it current — the quality of your plans depends on it, and inaccurate health information can produce unsuitable recommendations. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful or harmful purpose;
- Attempt to access another user’s data or circumvent authentication, rate limits, or security controls;
- Reverse engineer, scrape, or use automated means to access the Service except as expressly permitted;
- Interfere with or disrupt the Service or the AI systems behind it, or submit content that is abusive, infringing, or designed to elicit unsafe output;
- Resell, sublicense, or commercially exploit the Service without our written permission.
5. Subscriptions, billing, and cancellation
Some features require a paid subscription. Payments are processed by Stripe; by subscribing you also agree to Stripe’s terms. The price, billing frequency (e.g., monthly or annual), and features of your plan are shown at checkout.
- Automatic renewal: subscriptions renew automatically at the end of each billing period at the then-current price, and your payment method is charged, until you cancel.
- Cancellation: you may cancel at any time through the billing/account settings in the app (which open the Stripe customer portal) or by contacting us. Cancellation stops future renewals; access continues until the end of the current paid period.
- Refunds: except where required by law, payments are non-refundable and partial periods are not prorated.
- Price changes: we may change prices; we will give advance notice and changes apply to the next billing period.
- Free tier and limits: free and paid tiers are subject to usage limits (such as daily plan generations and message caps) that we may adjust.
6. Your content and our license
You retain ownership of the information and content you submit (such as your profile, logged meals, photos, and messages). You grant us a worldwide, non-exclusive license to host, process, and use that content solely to operate and improve the Service for you, including sending it to our AI provider to generate responses, as described in our Privacy Policy. You are responsible for ensuring you have the right to submit the content you provide.
7. Our intellectual property
The Service, including its software, design, text, and branding, is owned by Aether AI LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable, non-exclusive license to use the Service for your personal, non-commercial use, subject to these Terms. We reserve all rights not expressly granted.
8. AI-generated content
The Service uses artificial intelligence to generate meal plans and other content. AI output may be incorrect, may not reflect current nutritional science, and may not account for your specific health needs or allergies. We do not warrant the accuracy, completeness, or suitability of any AI-generated content. You are responsible for evaluating it and, where appropriate, confirming it with a qualified professional. 9. Disclaimer of warranties
To the fullest extent permitted by law, the Service and all content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any result (including any health, weight, or dietary outcome) will be achieved.
10. Limitation of liability
To the fullest extent permitted by law, Aether AI LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for any personal injury or health consequence, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the twelve (12) months before the claim or one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Aether AI LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, or your violation of these Terms or of any law or third-party right.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnification) will survive.
13. Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Florida will have exclusive jurisdiction over any dispute that is not otherwise subject to arbitration or small-claims resolution, and you consent to personal jurisdiction there. Nothing in these Terms limits any non-waivable rights you have under the consumer-protection laws of your home jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
